By using our services, you are agreeing to these Terms and Conditions published at www.seyedsgardening.com and www.hortplus.au. We are delighted to accept your request to perform high standard gardening services at your premises and offer you high quality horticultural products. You are required to read these Terms & Conditions carefully before accepting any quotation and signing any contract. The following Terms and Conditions are to make a transparent transaction, bound by any form of contract and quotation, to protect both parties and will apply to all Quotations and/or Contracts unless specifically modified or excluded in writing by Seyed’s Gardening Services (HORTplus). These Terms & Conditions may have changed since the last time you visited our Sites.

Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions.

• "the Contractor” means Seyed’s Gardening Services (HORTplus) and their employees.

• “the Customer” means the person, firm or company to be supplied with the Services and or products by the Contractor.

• “the Site” means the location where the works are to be performed by the Contractor.

• “Quotation” means the documents including detailed prices and plans describing the Works provided by the Contractor.

• ” the Contract” means the virtual or printed agreement for services made between the Contractor and the Client to which these conditions apply.

• “Start Date” is the agreed date between the Contractor and the Client to start the work.

• "the Products " means the goods, living or non-living materials, and or other items to be supplied to the Site by the Contractor.

• “the Services" means the services to be supplied under the Contract.

• “Intellectual Property” means the software-based plans, drawings and quotations offered by the Contractor before or after signing the contract).

Quotation

• The Quotation is valid for a mentioned time in the quote only.

• The quotation is based on the conditions viewed at the time of inspection and any extra works, or costs due to unknown difficulties or changes which were not explained at the time of inspection will be paid by the Client.

• The Quotation price can be revised by the Contractor by prior notification to the client in case of events happening out of the Contractor’s control such as changing the cost of materials, fuel.

Work

• In the case of any out-of-control event such as heavy rain or storm, the Contractor needs to contact the Client to schedule another time to complete the work.

• The Client requires to provide adequate access the site.

• The Client warrants that the site is free from tree stumps not specified to be removed, covered wells or other cavities, service pipes, and cables, sewage or land drains, foundations or other hazards or obstructions which are not discoverable upon visual inspection of the surface of the site.

• The Client is responsible for irrigation, fertilizing and pest control of living plant material, including turf, shrubs, trees, plants, fresh wreaths or hanging baskets following delivery/practical substantial completion.

• The Client is responsible for ensuring the safety of their children, family members and pets, on their premises, while the work is in process.

• The Services undertaken by Seyed’s Gardening Services (HORTplus) carries appropriate public liability insurance. Seyed’s Gardening Services (HORTplus) is not liable for and accepts no responsibility for unavoidable damage or loss of any nature which is not caused by our negligence or by a breach of the Terms of our quotation.

• In case of any cancellation or postponement of the contract by the Client, they need to inform the Contractor at least 24 hours prior to the agreed start time. Failure to notice of job cancellation will suffer full charges for any materials purchased.

• If for any reason, the Client is not satisfied with the work provided, they need to contact Seyed’s Gardening Services (HORTplus), within 24 hours and we would be happy to discuss all concerns.

Deposit & Payment

• Unless otherwise agreed in writing by the Contractor, payment for all fees, expenses, and charges in respect of the Services and Products shall be made by direct deposit, cash, or cheque on or before the "Due Date" on the Company's invoice or quotation.

• Depending on the size of the job, a deposit of 20% may be required prior to the commencing of work. All unpaid invoices must be paid before further work can be undertaken on a property.
